The Supreme Court has decided to tackle another local gun ban, this time in Chicago, where a lower court upheld an ordinance outlawing handguns. The decision indicates that the Roberts Court wants to clarify further its decision in Heller, which struck down a similar ban in Washington DC as unconstitutional. Distinguish Chicago from D.C.? Intriguing!
They are able to be distinguished pretty easily from a legal standpoint. Megan McArdle had a pretty good write up on her blog yesterday as to the different subtleties in the 14th Amendment that will more easily allow the law to be challenged at the state level.
